Overview
NRI or overseas marriages can be solemnized under the Special Marriage Act or the Foreign Marriage Act, 1969. This type of marriage is meant for Indian citizens residing outside India or for marriages between an Indian and a foreign national.
Eligibility Criteria
- One or both partners must be Indian citizens.
- Both must be of marriageable age 21 for groom, 18 for bride.
- Both should be unmarried and capable of giving consent.
- If one partner is foreign, a “No Objection Certificate (NOC)” is required from their embassy.
Documents Required
- Valid passports and visas
- Address proof (Indian and abroad)
- Birth certificates
- NOC from foreign embassy (if applicable)
- Divorce or death certificate (if previously married)
- Passport-size photos
- Two witnesses with valid IDs
Marriage Registration Process
- File a notice of intended marriage before the Marriage Officer (Indian Embassy/Consulate).
- The notice remains open for public objection for 30 days.
- After no objection, the marriage is solemnized before the officer.
- The marriage certificate is issued by the embassy or registrar.
Timeline
30–45 working days.
Government Fee
₹2,000–₹5,000 (depending on location and embassy).
