Court Marriage
(Under Special Marriage Act, 1954)

Overview

A Court Marriage is a legally recognized union solemnized before a Marriage Officer under the Special Marriage Act, 1954. It’s ideal for couples of any religion who wish to marry without religious rituals. The marriage becomes valid when both partners sign the declaration in the presence of three witnesses and the Marriage Officer.

Eligibility Criteria

  • Groom must be 21 years or above, bride 18 years or above.
  • Both partners must be unmarried or legally divorced/widowed.
  • Both must be mentally sound and capable of consent.
  • Should not fall under the prohibited degree of relationship (as defined in the Act).
  • One of the partners must have resided in the district for at least 30 days before application.

Documents Required

  • Aadhar Card, Passport, or Voter ID (Identity proof)
  • Birth certificate / 10th mark sheet (Age proof)
  • Passport-size photographs (6 each)
  • Residence proof of both
  • Joint affidavit stating marital status, nationality, and address
  • Divorce decree / Death certificate (if applicable)
  • Witnesses’ ID and photos (3 witnesses)

Marriage Registration Process

  • Notice Submission: File a marriage notice at the district Marriage Registrar’s office.
  • Public Notice Period: A 30-day period is provided for any objections.
  • Verification: Registrar verifies documents and eligibility.
  • Marriage Declaration: Both partners and 3 witnesses sign the declaration.
  • Certificate Issued: Marriage certificate is granted on the same day of solemnization.
